State - Owned Enterprises which were formed on the basis of mandate Article 33 1945 Constitution Republic Indonesia, in their journey carrying out activities various business fields obtain purchases to carry monopolies. This exception is further strengthened by 51 Law Number 5 1999 concerning Prohibition Monopolistic Practices and Unfair Business Competition . In general, there are natural monopoly law. paper contains a review proper implementation for State-Owned (SOE’S), as well policies implemented (SOE’S) so not violate provisions related competition, referred Clusterization, Synergy Holding. So that end right formula will be found regarding Monopoly Rights from correctly, both these state-owned enterprises progress because Quality (Natural Monopoly) only rely constitutional provide rights Law.
